Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Avetria Tech Private Limited (“First Draft”, “we”, “us”, or “our”), the company that operates the First Draft website at getfirstdraft.com and the associated applications, tools, and services (together, the “Service”).

By creating an account, clicking “I agree”, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated here by reference. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a newsroom, publication, or other organisation, you represent that you have authority to bind that organisation to these Terms, and “you” refers to that organisation.

First Draft is an AI-assisted writing platform built for journalists, editors, and media professionals. It helps you turn notes, source material, and briefs into polished, SEO-ready drafts, and provides a suite of editorial tools, including a News Writer, Headline Generator, Fact-Checker, Translator, Proofreader, and Summarizer.

The Service uses third-party artificial-intelligence models to generate suggestions and text based on the inputs you provide. We may add, change, or remove features at any time to improve the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service. The Service is not directed to children, and you may not use it if you are barred from doing so under applicable law.

To use most features you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding access to your account and for all activity that occurs under it.

• We sign you in without a password - using a magic link or one-time code sent to your email, or your Google account. Keep your email inbox and Google account secure, and do not share login links or codes.
• Notify us promptly at kalpit@avetria.tech if you suspect any unauthorised use of your account.
• We may limit the number of devices or concurrent sessions per account to prevent abuse.

First Draft offers a free tier and paid subscription plans. Paid plan features, usage limits, and prices are described on our pricing page at the time you subscribe.

Prices and taxes

Prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes. Goods and Services Tax (GST) at the prevailing rate (currently 18%) is added at checkout where applicable.

Payment processing

Payments are processed by our third-party payment provider, Razorpay, using methods such as UPI AutoPay and major credit and debit cards. We do not store your full card details. Your use of Razorpay is subject to Razorpay’s own terms and privacy policy.

Auto-renewal and cancellation

Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You can cancel at any time from your account settings; your paid access continues until the end of the current billing period, after which it will not renew.

Refunds

Except where required by law, fees are non-refundable and there are no refunds or credits for partial billing periods, unused features, or downgrades. Any promotional pricing (including early-bird offers) applies only as described at the time of purchase.

“User Content” means any text, notes, source material, files, prompts, or other content you submit to the Service, and “Output” means the content the Service generates for you from those inputs.

You own your content

As between you and First Draft, you retain all rights you have in your User Content and, to the extent permitted by law, in the Output generated for you. We do not claim ownership of your editorial work.

Licence you grant us

You grant us a limited, worldwide, non-exclusive licence to host, store, process, transmit, and display your User Content and Output solely as needed to operate, secure, and improve the Service and to provide it to you - for example, sending your inputs to our AI model providers to generate Output. This licence ends when your content is deleted from our systems, subject to our retention obligations.

Your responsibilities

You represent that you have the necessary rights to your User Content and that it, and your use of any Output, does not infringe any third party’s rights or violate any law. You are solely responsible for the accuracy, legality, and editorial integrity of what you publish.

First Draft is an assistant, not a replacement for professional editorial judgement. Output is generated by AI models and may be inaccurate, incomplete, outdated, biased, or misleading, and may occasionally produce fabricated details (“hallucinations”).

• Always verify before you publish. You are responsible for fact-checking, editing, and confirming any Output - including quotes, statistics, names, and citations - against reliable primary sources.
• Output does not constitute legal, financial, medical, or other professional advice.
• The fact-checker and similar tools are aids to your reporting, not a guarantee of truth; a “pass” from any tool is not an endorsement of accuracy.

You retain full editorial control and responsibility for all content you publish or distribute using the Service.

You agree not to use the Service to:

• Create or spread content you know to be false with the intent to deceive, defame, harass, or mislead, including disinformation or deepfakes.
• Violate any law, or infringe intellectual-property, privacy, or publicity rights.
• Generate content that is unlawful, hateful, harassing, sexually exploitative of minors, or that incites violence.
• Upload malware, attempt to gain unauthorised access to the Service, or interfere with its security or integrity.
• Reverse-engineer the Service, scrape it, or use it to build a competing product, or resell or sublicense access without our written permission.
• Circumvent usage limits, rate limits, or access restrictions, or use automated means to access the Service except through interfaces we provide.

We may investigate suspected violations and cooperate with law-enforcement authorities as required.

The Service, including its software, design, branding, the “First Draft” name and logo, and all related intellectual property, is owned by First Draft or its licensors and is protected by law. Except for the rights expressly granted to you in these Terms, we reserve all rights. These Terms do not grant you any right to use our trademarks without our prior written consent.

If you send us feedback, ideas, or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use them for any purpose without obligation or compensation to you.

The Service relies on third-party providers, including AI model providers, our payment processor (Razorpay), infrastructure and hosting providers, analytics tools, and reCAPTCHA for fraud prevention. Your use of those services may be subject to their own terms, and we are not responsible for third-party services or content.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we reasonably believe your use poses a risk to the Service or to others.

On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive - including ownership, disclaimers, limitations of liability, and governing law - will continue to apply.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or that Output will be accurate or reliable, to the fullest extent permitted by law.

To the maximum extent permitted by law, First Draft and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or reputation, arising out of or relating to your use of (or inability to use) the Service - including any reliance on Output.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) ₹5,000. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless First Draft from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your published Output, or your breach of these Terms or of applicable law.

We may modify these Terms from time to time. If we make material changes, we will provide reasonable notice - for example, by posting the updated Terms with a new “Last updated” date or notifying you in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any mandatory rights you have as a consumer, you agree that the courts located in Ahmedabad, Gujarat will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

• Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and First Draft regarding the Service.
• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
